2013 Oct 25

A division bench of the Lahore High Court on Thursday referred the matter to the LHC chief justice after refusing to hear the Punjab government’s appeal seeking cancellation of bail granted to a Sri Lankan team attack’s accused by the trial court.

Citing personal reasons, the bench comprising Justice Shahid Hameed Dar and Justice Anwarul Haq refused to further proceed with the appeal and referred it to the chief justice with a request to fix the same before any other appropriate bench.

A deputy prosecutor general and police officers of the Model Town division were present in the court to attend the proceedings, however, Justice Dar, who headed the bench, refused to hold further proceedings of the appeal. On previous hearing, the bench had exempted the accused Zubair alias Nek Muhammad from personal appearance in the proceedings. The accused is presently in detention under Maintenance of Public Order.

In the appeal, the government pleaded that the accused had a key role in the attack on the cricket team and police had arrested him with the help of CCTV footage. It said prosecution had sufficient proof about the involvement of the accused in the attack. However, it said, the trial court released the accused on bail. The government prayed to the court to cancel the bail granted to Nek Muhammad. (The Newws)
